Terms of Service
McStatts' Printing
Effective date: [BLANK — set to the date this goes live]
Last updated: [BLANK — same as above]
These terms apply to the use of our website at mcstatts.com and to printing, apparel, signage, promotional product, and design services provided by McStatts' Printing, 220 E. Church Street, Cartersville, GA 30120.
By submitting a quote request, placing an order, or approving a proof, you agree to these terms.
Quotes and Orders
Quotes are estimates based on the specifications you provide. If the specifications change — quantity, stock, size, colors, finishing, artwork, or turnaround — the price may change. Quotes are valid for [BLANK — how many days? Common practice is 30. Needs a business decision.] unless stated otherwise.
An order is confirmed when we have your written approval of the specifications and, where applicable, your approved proof and any required deposit.
Your Artwork and Content
This is the most important section for both of us, so please read it carefully.
You are responsible for the content you send us. By submitting artwork, logos, images, text, or any other material for production, you represent and warrant that:
- You own that material, or you have the legal right and license to use it and to have it reproduced
- Reproducing it will not infringe any copyright, trademark, trade dress, right of publicity, or other right of any third party
- The content is not unlawful, defamatory, or otherwise prohibited
You agree to indemnify and hold McStatts' Printing harmless from any claim, demand, loss, or expense — including reasonable attorneys' fees — arising out of the material you supply or our reproduction of it at your direction.
We may decline any job at our discretion, including work we believe may infringe someone's rights or that we consider inappropriate to produce. Declining a job is not an opinion on the legality of your content.
We do not verify ownership of submitted artwork. If you are unsure whether you have the right to reproduce something, resolve that before sending it to us.
Proof Approval
For most jobs we will provide a proof — digital, printed, or a physical sample — for your review before production.
Once you approve a proof, the job goes to production as approved. You are responsible for reviewing the proof carefully, including spelling, grammar, names, dates, phone numbers, addresses, prices, layout, dimensions, color breaks, and placement.
Errors found after proof approval are not our responsibility, and reprinting to correct them will be charged as a new job. We recommend having a second person review every proof before you approve it.
If you decline a proof, production will not begin until you approve a revised version. [BLANK — is there a limit on included revisions before additional charges apply? Needs a business decision.]
Color
Color reproduction varies between devices, processes, and materials. Colors you see on a monitor or on a home or office printer will not match a commercial press exactly, and the same file printed on different stocks or by different processes will not match exactly.
If exact color is critical, request a press proof or a physical sample before production and specify your color standard. [BLANK — does McStatts' offer Pantone matching or press proofs, and at what charge? Needs a business decision.]
Quantity Tolerance
Commercial printing and apparel decoration involve setup and make-ready, and finished quantities can vary. Unless we agree otherwise in writing, we may deliver and invoice within a reasonable tolerance of the ordered quantity.
[BLANK — state the tolerance. Industry practice is commonly plus or minus 10 percent, with billing adjusted to the quantity actually delivered. Needs a business decision, and it should match how McStatts' actually invoices today.]
Turnaround and Same-Day Service
Turnaround times are estimates and begin when we have final approved artwork, approved proof, and any required deposit — not when the order is first placed.
Same-day printing and copy services are subject to availability, current production load, quantity, and materials in stock. Please call to confirm same-day availability before relying on it. We cannot guarantee same-day service for every job or every material.
We are not responsible for delays caused by circumstances outside our control, including supplier shortages, equipment failure, shipping carrier delays, weather, or utility interruptions.
Customer-Supplied Materials
If you supply your own garments, paper, or other materials for us to print on, you accept the risk of spoilage. Decoration processes have a normal spoilage rate, and we do not replace customer-supplied goods damaged in production.
We may inspect and decline customer-supplied materials that are unsuitable for our processes.
Payment
[BLANK — this entire section needs the actual business terms. Specify: accepted payment methods, whether a deposit is required and how much, net terms for established accounts, when payment is due, late fees or interest, whether new customers pay in advance, and whether card payments carry a processing fee. These should match what McStatts' already puts on invoices and quote forms.]
Cancellation and Changes
[BLANK — needs the actual policy. Specify: whether an order can be cancelled after approval, whether the customer is charged for work already completed and materials already purchased, and how change requests mid-production are handled and billed.]
File Storage
We keep customer artwork and production files indefinitely so we can fulfill reorders quickly and consistently. This is a convenience we provide, not a guarantee — we do not warrant that any particular file will be available in the future, and you should keep your own copies of anything you cannot replace.
You may ask us to delete your files at any time. If you do, a future reorder may require you to resubmit artwork and may incur a new setup charge.
Claims and Returns
Because our products are custom-manufactured to your specifications, they cannot be returned or resold. We do not accept returns on custom work.
If there is a defect in materials or workmanship, or the delivered job does not match the approved proof, contact us within [BLANK — how many days after delivery? Needs a business decision.] days of delivery so we can inspect the work. Where we are at fault, our remedy is to reprint or correct the job, or to issue a credit or refund, at our option.
Third-Party Storefronts
Our website links to separate online stores for promotional products and apparel that are operated by third parties. Orders placed on those sites are governed by that company's terms and policies, not these. We are not responsible for their content, pricing, availability, or fulfillment.
[BLANK — confirm which storefronts are current and how orders placed there are fulfilled: directly by the third party, or by McStatts'? This changes who is responsible for the order.]
Website Content
The content on mcstatts.com, including text, images, and our name and logo, belongs to McStatts' Printing and may not be copied or reused without permission.
We work to keep the site accurate, but we do not warrant that all information, pricing, or availability is complete or current. Nothing on this site is a binding offer.
Limitation of Liability
To the fullest extent permitted by Georgia law, our total liability for any claim arising out of an order is limited to the amount you paid for that order. We are not liable for indirect, incidental, or consequential damages, including lost profits, lost business, or costs arising from a missed deadline or event.
Governing Law
These terms are governed by the laws of the State of Georgia, without regard to conflict of law principles. Any dispute will be brought in the state or federal courts located in [BLANK — Bartow County is where the business is located and is the natural venue, but confirm with counsel before stating it.]
Changes to These Terms
We may update these terms. The version in effect when you place an order is the version that applies to that order. The effective date at the top of this page shows when it was last changed.
